Murdoch's papers, others condemned in phone-hack report

Senior judge Brian Leveson remarks on the findings of his yearlong inquiry into the phone-hacking scandal that shook up British media.

Updated at 10:35 a.m. ET: LONDON ? Rupert Murdoch?s newspapers and other British media were reckless in the pursuit of sensational stories "almost irrespective of the harm" caused, according to a major report on Britain's?phone-hacking scandal.

The findings of the year-long Leveson Inquiry criticized a ?failure of systems of management and compliance? at Murdoch?s News of the World (NoTW) tabloid, which was closed down as the full extent of their illegal actions became clear.

Lord Justice Leveson said if Murdoch and his son James did not know about the extent of phone-hacking at the paper, then there had been a "determined cover-up" by unidentified staff.

And if they had known then the Murdochs should have done something about it, he said. However, the judge added there was no evidence from which he could "safely infer" that Rupert Murdoch was aware of a wider problem.

The report is being watched by American lawmakers amid concerns that U.S. laws may have been broken.

Leveson did not recommend state regulation of the media ? or censorship in the eyes of some ? as some victims of press intrusion had demanded, but did propose a new self-regulatory body enshrined in law.

The inquiry was set up after it emerged that people working for the News of the World had hacked into messages on a phone belonging to?Milly Dowler, 13, while she was a missing person in 2002. She had been abducted and was murdered.

A string of other examples of phone-hacking and other examples of press intrusion then emerged.

In its report on Britain's phone-hacking scandal, the Leveson Inquiry described a failure of management systems at newspapers owned by Rupert Murdoch and others.

Leveson said it was not just Murdoch?s newspapers that were at fault, adding that?"outrageous" behavior by the press had "wreaked havoc with the lives of innocent people."

?There has been a recklessness in prioritizing sensational stories almost irrespective of the harm that the stories may cause and the rights of those who would be affected (perhaps in a way that can never be remedied),? his report said.

?Too many stories in too many newspapers are the subject of complaints from too many people,? it added.

But Leveson was scathing about the Murdoch empire and the News of the World in particular.?He said there was "a general lack of respect for individual privacy and dignity? at the paper.

And the judge said there had been a ?serious failure of governance? at the News of the World, News Corporation and its U.K. arm News International in dealing with the phone-hacking allegations.

?There was a failure on the part of the management at the NoTW to take appropriate steps to investigate whether there was evidence of wrongdoing,? he said.

Author J.K. Rowling and actress Sienna Miller testified at the Leveson inquiry, addressing the emotional pain they experience after having their privacy invaded by tabloid reporters. NBC's Michelle Kosinski reports.

'Determined cover-up'
Leveson said if Rupert Murdoch and his son James were kept in the dark then ?one or more parts of the management at the NoTW was engaged in a determined cover-up to keep relevant information about potential criminal activity within the organisation from senior management within NI.?

?? if James Murdoch had been the victim of a cover-up, or an attempt to minimise the gravity of the position, then the accountability and governance systems at NI would have to be considered to have broken down in an extremely serious respect,? he added.

Leveson said there was ?no evidence? from which he could ?safely infer that Rupert Murdoch was aware of a wider problem.?

But Leveson noted Rupert Murdoch did not appear to have followed up -- or arranged for his son James to follow up -- on the instructions Murdoch said he gave to Colin Myler, editor of the News of the World from 2007 to 2011, to ?find out what the hell was going on.?

Actor Hugh Grant took a starring role on Monday in a London courtroom, where he testified at a public hearing about alleged phone hacking by British tabloids. NBC's Stephanie Gosk reports.

?If News Corporation management, and in particular Rupert Murdoch, were aware of the allegations, it is obvious that action should have been taken to investigate them,? Leveson said.

The report noted evidence given to the inquiry that News International had been ?obstructive? during an early police investigation into phone-hacking.

?The approach taken by NI is far from what might be expected of a well-run corporation ? An organisational culture that is founded on integrity and honesty would require not only full co-operation with law enforcement, but also a determination to expose behaviour that failed to comply with the law,? the report said.

Leveson said that what was needed was a ?genuinely independent and effective system of self-regulation.?

The current Press Complaints Commission includes members of the media industry, but Leveson said his proposed new body should have no ?serving editors or members of the House of Commons or government.? He also said that the new body should?be recognized in law.

He said he was ?struck by the evidence of journalists who felt they might be put under pressure to do things that were unethical or against the [press standards] code.?

To address this, he said there should be a new whistleblowing hotline and the new board should ?encourage? media firms to include a ?conscience clause? in their employment contracts.

U.S. senator: 'Deplorable conduct'
Senator Jay Rockefeller, chairman of the Senate commerce committee, earlier signaled he would be paying close attention to the findings of the report.

In an emailed statement sent to NBC News before it was released, he called on investigators in the U.K. to hold media companies accountable for their ?deplorable conduct.?

The parents of murdered school girl Milly Dowler told the Leveson Inquiry how her phone had been hacked into when she went missing, giving them false hope that she may still be alive. ITV's Damon Green reports.

Rockefeller said that was "deeply concerned" that media companies "may have violated U.S. laws and injured U.S. citizens."

He said he hoped Leveson?s report and other investigations would hold the media organizations involved ?accountable for their deplorable conduct.?

?While I understand that the main goal of this report is to make policy recommendations, the core of the inquiry remains the illegal and unethical practices of newspapers owned by the News Corporation,? Rockefeller said.

Britain's former Prime Minister Tony Blair admitted he was very close to News International as Prime Minister - but he told the Leveson Inquiry it was a working relationship, not a close one. Testimony was briefly interrupted by a protestor who accused Blair of being a "war criminal." ITN's Tom Bradby reports.?

Former top aide to UK PM David Cameron charged in perjury case

Meanwhile, former News of the World editor Andy Coulson, who was later hired as U.K. Prime Minister David Cameron's chief media adviser, and Rebekah Brooks, the former CEO of News International, appeared in court Thursday to face charges related to allegations of corrupt payments made to public officials, ITV News reported. They were later released on bail.

SAO PAULO (AP) - Lionel Messi, Cristiano Ronaldo and Andres Iniesta are the finalists for FIFA's world player of the year award.

They were picked from a list of 23 candidates for this year's Ballon d'Or, with Messi looking to become the first player to win the award four times. The Argentina and Barcelona playmaker won the award last three years.

The winner will be announced in Switzerland on Jan. 7.

The finalists for the women's world player award are five-time winner Marta and United States duo Alex Morgan and Abby Wambach.

Spain coach Vicente Del Bosque, former Barcelona coach Pep Guardiola and Real Madrid coach Jose Mourinho were in the running for the world coach of the year award.

A woman accused of luring a man to his death in revenge for her husband?s murder told a Florida court Monday that she acted in self-defense.

Janepsy Mesa Carballo, 35, who is on trial for second-degree murder, , told a Miami-Dade court that she feared that Ilan Nissim would harm her and her family when she shot him.

?In my mind, he was chasing me,? Janepsy Mesa Carballo said of Nissim. ?His people, as he called it, were chasing me.?

She testified in hopes of having her murder charge thrown out under Florida?s Stand Your Ground law.

Carballo said that she lived in fear of Nissim, who was an acquaintance and business partner of her husband, Orlando Mesa.

Shot six times in the back
Mesa and Carballo?s toddler son were shot outside their North Miami home in April 2008. Her husband was killed and their 2-year-old boy was injured but survived.

A month later, Carballo shot and killed Nissim inside her home, according to authorities.

Prosecutors say Carballo was out to avenge her husband's death, claiming that she lured Nissim to her home the night she fatally shot him six times in his back.

But Carballo said that she wasn?t expecting Nissim that night, and said that his visit turned violent. She acted in self-defense, she said.

U.S. Healthcare: Newly insured patients may have trouble finding primary care physicians

ScienceDaily (Nov. 26, 2012) ? Implementation of the Affordable Care Act -- now assured by the re-election of President Obama -- is expected to result in up to 50 million currently uninsured Americans acquiring some type of health insurance coverage. But a study by researchers at the Mongan Institute for Health Policy at Massachusetts General Hospital (MGH) finds that a significant percentage of the primary care physicians most likely to care for newly insured patients may be not be accepting new patients. The investigators note that strategies designed to increase and support these "safety-net" physicians could help ensure that newly covered patients have access to primary care.

"This study raises very serious concerns about the willingness and ability of primary care providers to cope with the increased demand for services that will result from the ACA," says Eric G. Campbell, PhD, of the Mongan Institute, senior author of the report to be published in the American Journal of Medical Quality. "Even with insurance, it appears that many patients may find it challenging to find a physician to provide them with primary care services."

In 2000 the Institute of Medicine published a report on the health care "safety net" -- physicians and organizations caring for a significant proportion of uninsured or Medicaid-covered patients -- that noted a lack of enough safety-net providers and the chronic underfunding of Medicaid. The Affordable Care Act was designed to ensure almost universal health insurance coverage, including expanding the number of individuals eligible for Medicaid. The authors of the current study note that many newly covered patients are likely to turn to physicians in the already-stressed health care safety net and that areas where such patients are likely to live often have limited primary care services. In addition, studies have suggested that physicians caring for disadvantaged groups of patients may provide lower-quality care.

The authors set out to better understand the physicians in the primary care safety net, to determine their willingness to accept new Medicaid patients and to assess their attitudes about and interest in quality improvement activities. As part of a 2009 survey of medical professionalism, physicians were asked to indicate the approximate percentage of their patients who were covered by Medicaid or were uninsured and unable to pay. They also were asked whether they were accepting new Medicaid or uninsured patients, along with several questions regarding services they provided to vulnerable populations and their attitudes towards and participation in quality improvement activities. Because of their focus on the primary care safety net, the investigators restricted their analysis to responses from internists, pediatricians and family practitioners.

Of 840 primary care physicians responding to the survey, 53 percent were safety-net providers, defined as having patient panels with more than 20 percent uninsured or Medicaid patients. Half of all responding primary care physicians indicated they were accepting new patients who either were covered by Medicaid or had no means of paying for their care. But safety-net physicians were considerably more likely to accept both patient groups, with 72 percent taking new Medicaid patients and 61 percent taking new patients with no medical coverage. There were no significant differences between the physician groups in reported attitudes about or participation in quality improvement efforts, and safety-net physicians reported greater awareness of and efforts to address disparities in health care than did non-safety-net physicians.

The authors note that the concentration of care for Medicaid and uninsured patients among a limited number of safety-net physicians and the fact that 28 and 39 percent, respectively, of those physicians are not accepting new Medicaid and uninsured patients indicate that the current health care safety net may have reached its capacity. In addition, they note, safety-net physicians' interest in quality improvement and attention to health care disparities suggests that reported differences in the quality of care they provide probably reflect limited resources available to their practices or barriers to care within the local communities.

"We found the attitudes of safety-net primary care physicians are consistent with providing equitable, universal care, and they were almost twice as likely to look out for possible racial and ethnic disparities within their practices," says Lenny L?pez, MD, MPH, MDiv, of the Mongan Institute, corresponding author of the report. "We're already aware of the need for more primary care physicians, and these results make it apparent that the need for safety-net PCPs is even more critical. We also found that safety-net physicians were more likely to be women, under-represented minorities or foreign medical graduates, so efforts to bring more such physicians into primary care, along with efforts to close the income gap between safety-net and non-safety-net PCPs, could help expand the safety net."

Brent climbs above $111 after Greek debt deal

SINGAPORE (Reuters) - Brent crude rose above $111 per barrel on Tuesday as optimism coursed through financial markets after Greece's international lenders reached a deal on a new debt target, although worries about a looming U.S. fiscal crisis kept a lid on gains.

The euro hit a one-month high and Asian shares climbed for a seventh straight day after euro zone finance ministers and the International Monetary Fund agreed on a package of measures to reduce Greek debt needed to release another tranche of loans to the near-bankrupt economy.

Brent crude was up 13 cents at $111.05 a barrel by 0301 GMT and U.S. crude gained 24 cents to $87.98, following losses on Monday.

Oil prices were also supported by a softer dollar, which makes commodities priced in the greenback cheaper for holders of other currencies.

But traders cautioned that oil price gains may be checked as the longer-term outlook for Europe remained uncertain.

"Markets for now are pricing in that Greece will be refunded, but there are structural problems about the euro zone that needs fixing," said Ben Taylor, sales trader at CMC Markets in Sydney.

"It's amazing how (Europe) keeps finding ways to buy themselves more time. They've simply kicked the can down the road for the moment."

FISCAL CLIFF

Market attention is now expected to focus on the fiscal policy standoff in the United States. A lack of progress on that front will muddy the outlook for demand from the United States, the world's top oil consumer.

Republicans in the U.S. Congress on Monday called on President Barack Obama to detail long-term spending cuts to help solve the country's fiscal crisis, while holding firm against the income tax rate increases for the wealthy that Democrats seek.

While Congress returned from its Thanksgiving holiday break amid increasing talk about long-term tax reform plans and a need to compromise, the two parties showed no signs yet of having found a way around the short-term tax obstacle necessary to head off the fiscal cliff on December 31.

"If we do hit the fiscal cliff, the U.S. will dip back into a recession which is not good for anyone," Taylor said.

The fiscal cliff's approximately $600 billion in tax hikes and spending cuts that would begin in 2013 would push the U.S. economy back into recession, according to the non-partisan Congressional Budget Office.

"We do see markets, at least for now still pricing in some kind of agreement to take place before the end of the year, but we're going to have to see compromise from both parties."

SUPPLY CONCERNS

The oil market is also keeping an eye on the political crisis in Egypt that has triggered worries about supply.

President Mohamed Mursi provoked outrage last week that led to violent protests when he issued a decree that put beyond judicial review any decision he takes until a new parliament is elected, drawing charges he had given himself the powers of a modern-day pharaoh.

Egypt's ruling Islamists tried to defuse the political crisis on Monday, with Mursi backing a compromise over his seizure of extended powers and his Muslim Brotherhood calling off a planned demonstration.

But opponents plan to go ahead with a big demonstration on Tuesday to demand he scrap the decree, threatening more turmoil for a nation that has been stumbling towards democracy for almost two years since president Hosni Mubarak was ousted.

News that OPEC member Nigeria is expected to see oil exports drop to 1.98 million barrels per day in January from a planned 2.12 million bpd in December also supported crude.

Traders are now waiting for weekly U.S. inventory data due out on Tuesday and Wednesday. Analysts forecast a build in crude and refined product stockpiles for the week to November 23.

I can't imagine our lives without them.? Those boys are the best thing that ever happened to us.? With that said, I am going to start posting some quotes/sayings/etc. about parenting?that I find thoroughly annoying.? I guess it seems like?a "Negative Nancy" thing to do but so be it.

Eight policemen wounded in Russian prison protest

MOSCOW (Reuters) - Eight Russian policemen were injured trying to disperse a crowd outside a prison where 250 inmates staged a roof-top protest demanding the release of a group of fellow prisoners from a punishment cell, authorities said on Sunday.

Russian state television showed pictures of a group of inmates standing on the roof of the prison holding white banners reading "people, help" in the town of Kopeysk near the industrial city of Chelyabinsk in the Urals mountains.

Details of the incident remain unclear with human rights activist Oksana Trufanova telling the Echo Moskvy station that OMON special police troops attacked a group of inmates' relatives outside the prison.

"They beat us with batons. Their eyes were shining. I had never been in such mayhem," Trufanova said. Police said 38 people were detained, but denied OMON officers had beaten people outside the prison.

Trufanova said the protest was a consequence of regular beatings in Kopeysk prison. The local prison authority said in a statement the situation inside the prison was now stable and under control.

Police said the troops were attacked by groups of drunken youths who were throwing bottles and shouting obscenities. Prison mutinies in Russia are relatively rare.

More than 700,000 Russians are currently behind bars and human rights activists regularly complain of poor living conditions, cases of torture, beatings and disease in prisons.

Conditions in Russian prisons came to international attention after Sergei Magnitsky, a lawyer for equity fund Hermitage Capital died a Moscow prison. The Kremlin's own human rights council says he was probably beaten to death.

The local prison authority said the protesters had no demands other than the release of a group of their fellow inmates from a punishment cell. It said the group had violated prison rules and the demand to release them was illegal.
