Say this for BlackBerry ? they seem to know they have an app problem and they?re working hard trying to fix it. A BlackBerry spokesperson has told AllThingsD that the company is ?in talks? with both Instagram and Netflix (NFLX) to make mobile applications specifically for the BlackBerry 10 platform. However, the spokesperson also added that they ?could not confirm when those apps will make their way into the store,? so BlackBerry fans may have to wait a while before they have access to two of the biggest apps in the mobile world. As we noted earlier, Instagram?s absence on BlackBerry 10 is particularly glaring because RIM claims it has a strong partnership with Instagram owner Facebook (FB).

ATLANTA ? A new law on Georgia car taxes has made leasing a vehicle a less attractive and more expensive option than buying a car outright.

The Atlanta Journal-Constitution (http://bit.ly/Uzy1FH) reports a bill that eliminated the birthday tax on new cars does not account for car leases ? which represent about 42 percent of new car transactions in the state.

After March 1, consumers who buy new cars will pay a single 6.5 percent sales tax at the time of purchase. Consumers who lease cars will pay the same 6.5 percent title tax as people who buy cars outright, but will also have to continue paying monthly sales taxes in the jurisdiction in which they leased the car.

The Georgia law may be the first of its kind, said Danielle Fagre, senior vice president of the American Financial Services Association, whose members include lease-financing companies.

"We don't know any other state that treats leases negatively compared to purchases from a tax perspective," Fagre added. He said Georgia has a higher rate of leases than most other states. The national car-leasing average is about 17 percent compared to 42 percent in Georgia, according to Experian Automotive.

The newspaper reports state lawmakers will likely tweak the-car tax bill this year.

"Almost every time, there will be one or two or three things that will wind up with unintended consequences, and things not turn out the way we had intended to at the time," said Rep. Mickey Channell, R-Greensboro. "The car title thing is certainly one of them."

Rep. Tom Rice, R-Norcross, has filed proposed legislation aimed at addressing the issue by lowering the initial title tax on leased cars to 4 percent. However, the proposed legislation would not address the monthly sales tax, and Rice says the Legislature may struggle to help cities and counties recover projected revenue losses from the elimination of the birthday tax.

"We need to ensure there's enough revenue on these vehicles to make up for the lost (birthday tax)," Rice said. "That's why there's any title fee on leased vehicles at all."

(AP) ? The Baltimore Ravens' reputation for trash-talking arrived at the Super Bowl before they did.

While the Ravens were en route from Baltimore to the Big Easy, the San Francisco 49ers were already preparing for war of words with the chattiest team in the NFL.

"Most teams don't really talk that much, but I've heard stories about them talking a lot," San Francisco guard Alex Boone said. "Guys have told me not to get into it with them. We're not here to get into a yelling match."

That might change a bit Sunday when both teams play for the NFL championship at the Superdome.

The Ravens developed their swagger years ago under coach Brian Billick, who rarely backed away from a microphone and made no effort to put a muzzle on his players, most notably Shannon Sharpe and Tony Siragusa ? both of whom are now being paid to blab as television commentators.

Baltimore's current coach, John Harbaugh, doesn't encourage such brashness. But he won't stop it, either. After the Ravens beat New England to win the AFC championship, Baltimore safety Bernard Pollard insisted that Patriots quarterback Tom Brady should be fined for a leg-up slide even though Brady apologized afterward.

Linebacker Terrell Suggs topped that in an interview with Yahoo Sports, calling the Patriots "arrogant" and telling them "to have fun at the Pro Bowl."

Now that he's on football's biggest stage, Suggs has taken it down a few decibels, judging by his tone at Monday's media interviews. Here's a bulletin: He said nothing the 49ers might consider clipping from a newspaper and pinning to the bulletin board for motivation.

"I'm going to talk to you guys with the obligated time that I'm supposed to talk to you guys ... and I'm going to stick to that," Suggs said.

Asked if he might say something juicy later in the week, Suggs replied, "Nothing I do is scripted. You've got to wait and see what I come up with."

It might be worth the wait, although Harbaugh seems to think Suggs and the rest of the team will resist the temptation.

"Our guys are class guys. We'll play with character, we'll play with class," Harbaugh said. "We'll be a tough, hard-nosed football team. That's the way we'll play. Before the game, after the game."

That's not what the 49ers have heard.

"Talk is cheap. I'll leave it at that," linebacker NaVorro Bowman said. "We've all got to play with those pads on. That's what does the talking for us."

Linebacker Ray Lewis does much of the talking for the Baltimore defense. After leading the unit in an emotional chant following each pregame workout, Lewis yells the signals on the field and usually has something bold to say to an opponent he's dropped to the turf.

"Ray and Suggs, they like to talk a lot but they're great players, so it's kind of warranted," 49ers fullback Bruce Miller said.

"I think that's just the way they motivate their team," San Francisco cornerback Tarrell Brown added. "Everybody feeds off that. Whatever works for them, that's good."

When Lewis told his teammates earlier this month that he was going to retire after the current postseason run, Suggs thought the team's vocal leader was merely gearing up for another speech.

"He always talks to the team before the game, the middle of the season and going into the playoffs," Suggs said. "I thought it was another day at the office, but he said some key words. It struck me. He said maybe it was time to start doing something else and it just kind of puzzled me and then it hit me. It really focused our team, not only to get it done for him, but just how precious this time and these moments are. You don't get these opportunities every day."

Lewis may the most prolific talker on the team, but he's not the only one who enjoys yapping. As soon as they got off the plane from Baltimore, Suggs, Ray Lewis, Ed Reed, Matt Birk, Ray Rice and Joe Flacco were made available to the media.

While Lewis discussed, among other things, his pending retirement, his family and his love for God, Reed talked about everything from his training habits to his experience as a punt, pass and kick participant in New Orleans more than two decades ago.

None of it was going to get the 49ers riled up before Sunday's game, which is just the way Harbaugh likes it.

"I think we're very respectful of our opponents," the coach said. "We always have been, and our opponents have respected us over the years. The team we're playing is built the same way. We've got a lot of respect for the 49ers. We've got a lot of respect for their coach, the coaching staff, their players, and I expect it to be played in that way."

Earlier this week, China Daily quoted an anonymous government source -- allegedly straight from the Ministry of Culture -- saying China is considering lifting a 12-year-old "ban" on game consoles soon. While it's was unclear how reliable the source was at the time, the Tokyo stock market sucked it up anyway, with Bloomberg observing a significant rise for Sony and Nintendo after the rumor was published. Then today we learned from Tech In Asia that Dongfang Daily followed up with two representatives from the Ministry of Culture, one of which said the department have never looked into lifting the ban, while the other person was more vague about the matter. But here's the thing: game consoles were never really banned in China. Allow us to set the record straight for you.

NRA says more gun control not a serious proposal

(AP) ? Banning some assault weapons and requiring background checks for all firearms purchases aren't a serious attempt to reduce gun violence, a top National Rifle Association official warned Tuesday as Congress geared up for the year's first hearing on the subject.

Wayne LaPierre, executive vice president of the NRA, said the country must instead focus on boosting security at schools, enforcing existing gun laws and taking more steps to deny guns to people with mental illnesses.

"Law-abiding gun owners will not accept blame for the acts of violent or deranged criminals. Nor do we believe the government should dictate what we can lawfully own and use to protect our families," LaPierre said in testimony he planned to deliver Wednesday at a hearing by the Senate Judiciary Committee.

LaPierre's statement, released Tuesday by the NRA, came nearly seven weeks after the massacre at Sandy Hook Elementary School in Newtown, Conn., in which a gunman killed 20 children and six adults. The horrific slayings have revived the national debate over gun control, with President Barack Obama proposing a range of restrictions last week and members of Congress introducing legislation on the subject.

LaPierre's testimony was similar in substance but somewhat milder in tone than some statements the organization has made recently.

Less than two weeks after the mass shooting, LaPierre attacked the "media machine" for blaming the gun industry for attacks like Newtown and said what was needed to prevent the next massacre were armed guards and police in every school. Earlier this month, the NRA ran a television ad calling Obama an "elitist hypocrite" for voicing doubts about having armed school guards while his own children are protected that way at their school. While Obama's children have Secret Service protection, officials at their school say its own guards don't carry guns.

"We need to be honest about what works and what does not work. Proposals that would only serve to burden the law-abiding have failed in the past and will fail in the future," LaPierre said in his prepared remarks.

A ban on some semi-automatics considered to be assault weapons was tried from 1994 to 2004 and failed to reduce crime, he said. He also said background checks will never be universal because criminals won't submit to them. Both are among measures that Obama is seeking.

Sen. Dianne Feinstein, D-Calif., has already introduced legislation taking similar steps to Obama's proposals, including banning assault weapons and magazines that house more than 10 rounds of ammunition.

She said Tuesday that she will hold her own hearing on gun control because she was unhappy that three of the five witnesses testifying to the Judiciary panel on Wednesday are "skewed against us." Feinstein is a member of the committee.

Despite the momentum gun-control advocates have gained since the Newtown shootings, it will be difficult for them to prevail in Congress this year because of the popularity of guns in many states ? including several represented by Democratic senators ? and the formidable muscle of the NRA on Capitol Hill, lawmakers and other say. Among other obstacles, the Republican-run House has shown little immediate interest in making dramatic changes in the laws.

"It's hard," Feinstein said of gun legislation prospects. "I know it's hard. It doesn't mean I shouldn't try."

Asia's trend-setters feeling iPhone fatigue

SINGAPORE?? Apple's iconic iPhone is losing some of its luster among Asia's well-heeled consumers in Singapore and Hong Kong, a victim of changing mobile habits and its own runaway success.

Driven by a combination of iPhone fatigue, a desire to be different and a plethora of competing devices, users are turning to other brands, notably those from Samsung Electronics, eating into Apple's market share.

In Singapore, Apple's products were so dominant in 2010 that more devices here ran its iOS operating system per capita than anywhere else in the world.

But StatCounter, which measures traffic collected across a network of 3 million websites, calculates that Apple's share of mobile devices in Singapore ? iPad and iPhone ? declined sharply last year. From a peak of 72 percent in January 2012, its share fell to 50 percent this month, while Android devices now account for 43 percent of the market, up from 20 percent in the same month last year.

In Hong Kong, devices running Apple's iOS now account for about 30 percent of the total, down from about 45 percent a year ago. Android accounts for nearly two-thirds.

"Apple is still viewed as a prestigious brand, but there are just so many other cool smartphones out there now that the competition is just much stiffer," said Tom Clayton, chief executive of Singapore-based Bubble Motion, which develops a popular regional social media app called Bubbly.

Leading indicators
Where Hong Kong and Singapore lead, other key markets across fast-growing Asia usually follow.

"Singapore and Hong Kong tend to be, from an electronics perspective, leading indicators on what is going to be hot in Western Europe and North America, as well as what is going to take off in the region," said Jim Wagstaff, who runs a Singapore-based company called Jam Factory?that's developing mobile apps for enterprises.

Southeast Asia is adopting smartphones fast ? consumers spent 78 percent more on smartphones in the 12 months up to September 2012 than they did the year before, according to research company GfK.

Android rising
Anecdotal evidence of iPhone fatigue isn't hard to find: Where a year ago iPhones swamped other devices on the subways of Hong Kong and Singapore, they are now outnumbered by Samsung and HTC smartphones.

While this is partly explained by the proliferation of Android devices, from the cheap to the fancy, there are other signs that Apple has lost followers.

Singapore entrepreneur Aileen Sim recently launched an app for splitting bills called BillPin, settling on an iOS version because that was the dominant platform in the three countries she was targeting ? Singapore, India and the United States.

"But what surprised us was how strong the call for Android was when we launched our app," she said.

Indeed, 70 percent of their target users ? 20-something college students and fresh graduates ? said they were either already on Android or planned to switch over.

"Android is becoming really hard to ignore, around the region and in the U.S. for sure, but surprisingly even in Singapore," she said. "Even my younger early-20s cousins are mostly on Android now."

BillPin launched an Android version this month.

Standing out from the crowd
Napoleon Biggs, chief strategy officer at Gravitas Group, a Hong Kong-based mobile marketing company, said that while Apple and the iPhone remained premium brands there, Samsung's promotional efforts were playing to an increasingly receptive audience.

For some, it is a matter of wanting to stand out from the iPhone-carrying crowd. Others find the higher-powered, bigger-screened Android devices better suited to their changing habits ? watching video, writing Chinese characters ? while the cost of switching devices is lower than they expected, given that most popular social and gaming apps are available for both platforms.

"Hong Kong is a very fickle place," Biggs said.

Janet Chan, a 25-year-old Hong Kong advertising executive, has an iPhone 5, ?but its fast-draining battery and the appeal of a bigger screen for watching movies is prodding her to switch to a Samsung Galaxy Note II.

"After Steve Jobs died, it seems the element of surprise in product launches isn't that great anymore," she said.

Shifting trends
To be sure, there are still plenty of people buying Apple devices. Stores selling their products in places such as Indonesia were full over the Christmas holidays, and the company's new official store in Hong Kong's Causeway Bay has queues snaking out of the door most days.

But the iPhone's drop in popularity in trendy Hong Kong and Singapore is mirrored in the upmarket malls of the region.

"IPhones are like Louis Vuitton handbags," said marketing manager Narisara Konglua in Bangkok, who uses a Galaxy SIII. "It's become so commonplace to see people with iPads and iPhones so you lose your cool edge having one."

In the Indonesian capital Jakarta, an assistant manager at Coca Cola's local venture, Gatot Hadipratomo, agrees. The iPhone "used to be a cool gadget, but now more and more people use it," Hadipratomo said.

There is another influence at play: hip Korea. Korean pop music, movies and TV are hugely popular around the region, and Samsung is riding that wave. And while the impact is more visible in Hong Kong and Singapore, it also translates directly to places like Thailand.

"Thais are not very brand-loyal," says Akkaradert Bumrungmuang, 24, a student at Mahidol University in Bangkok. "That's why whatever is hot or the in-thing to have is adopted quickly here. We follow Korea, so whatever is fashionable in Korea will be a big hit."

Hackers take over sentencing commission website

WASHINGTON (AP) ? The hacker-activist group Anonymous says it hijacked the website of the U.S. Sentencing Commission to avenge the death of Aaron Swartz, an Internet activist who committed suicide. The FBI is investigating.

The website of the commission, an independent agency of the judicial branch, was taken over early Saturday and replaced with a message warning that when Swartz killed himself two weeks ago "a line was crossed."

The hackers say they've infiltrated several government computer systems and copied secret information that they now threaten to make public.

Family and friends of Swartz, who helped create Reddit and RSS, say he killed himself after he was hounded by federal prosecutors. Officials say he helped post millions of court documents for free online and that he illegally downloaded millions of academic articles from an online clearinghouse.

The FBI's Richard McFeely, executive assistant director of the Criminal, Cyber, Response, and Services Branch, said in a statement that "we were aware as soon as it happened and are handling it as a criminal investigation. We are always concerned when someone illegally accesses another person's or government agency's network."

Militant groups clash in NW Pakistan, 24 killed

PESHAWAR, Pakistan (AP) ? A Pakistani official says clashes between two Islamic militant groups over control of a prized valley near the Afghan border have killed 24 people.

Arshad Khan of the Khyber tribal region said Saturday that the clashes started Friday when the main militant group Tehrik-e-Taliban captured a base of another militant group, Ansarul Islam, in the Tirah valley. Ansarul Islam then tried to retake the base, with fighting continuing into the next day.

A military officer speaking on condition of anonymity said most of the dead were militants but some local tribesmen were also killed.

The remote and mountainous valley is valued by militant groups as a base. It's difficult for the Pakistani military to enter and allows militants easy access to Afghanistan and other tribal agencies.

Obama Presses Liberal Agenda as He Starts 2nd Term

From gun control to gay rights, President Barack Obama's second-term agenda is shaping up as an unabashedly liberal wish list.

In less than a week, he's vowed to tackle climate change and protect government entitlements. His administration has lifted a ban on women in combat and expanded opportunities for disabled students. Proposals for stricter gun laws have already been unveiled, and plans for comprehensive immigration reform, including a pathway to citizenship for millions of illegal immigrants, are coming next week.

Obama's full embrace of such an agenda suggests a president both freed for action by his re-election win and seeking to capitalize on it.

"There is a deep recognition that he has a short period of time to get a lot done," said Jennifer Psaki, Obama's 2012 campaign spokeswoman. "The American people are seeing a man who is determined to finish what he started in his first term, pushing through his agenda without the burden of running for re-election."

But following through and winning approval for his proposals will require cooperation from a Congress that is nearly as divided now as it was before the November elections.

"If the president pursues that kind of agenda, obviously it's not designed to bring us together," said Senate Minority Leader Mitch McConnell of Kentucky, who calls the start of Obama's second term "a new era of liberalism."

And it's not just congressional Republicans who could stand in Obama's way as he seeks to make good on his pledges. Senate Democrats from conservative-leaning states ? who, unlike Obama, still face future elections ? may have reservations about backing a liberal agenda in the lead-up to the 2014 midterms.

Democratic resistance is already proving to be a problem for some of the toughest gun control measures that Obama proposed ahead of his inauguration in response to the elementary school shooting in Newtown, Conn. An assault weapons ban, in particular, appears to be in jeopardy, with Senate Majority Leader Harry Reid of Nevada among the Democrats yet to voice support.

Obama's tilt to the left follows a presidential campaign that left open questions about what policies he would pursue if he won a second term. His most specific campaign pledge was to let George W. Bush-era tax cuts expire for the wealthiest Americans, a step he was able to achieve during the "fiscal cliff" negotiations in late December.

That's why many of his strongest supporters were surprised ? some pleasantly ? by the issues he raised in his inaugural address, particularly his call for tackling the threat of climate change, a topic that garnered little attention during the campaign.

And after campaigning on a balanced approach to deficit reduction, including making tough choices on entitlement programs, Obama used his inauguration to extol the virtues of Medicare, Medicaid and Social Security. He made just one reference to the huge federal deficit.

Obama has previously said he's willing to put government entitlements on the table as Washington seeks to reduce the deficit, and aides say his inaugural address doesn't change that.

Obama also became the first president to use the word "gay" in an inaugural address, asserting that the nation's journey is not complete until "our gay brothers and sisters are treated like anyone else under the law."

Progressive groups welcomed the president's rhetoric, but made it clear that words alone would not be enough.

Adam Green, co-founder of the political action group Progressive Change Campaign Committee, said that if the president's inaugural address does become a template for his second-term governing strategy, "that will allow the president to win big victories and secure a legacy of bold progressive change that helped millions of Americans."

"We hope he goes that route, and we will proudly rally to his side if he does," Green said.

It remains to be seen how vigorously Obama pursues the agenda items he outlined in his inaugural address. White House officials have already struggled this week to back up his rhetoric with specific policy proposals

Still, people close to the president say he feels emboldened since winning re-election and wants to act quickly on progressive issues that eluded him during his first term. His supporters have also created a campaign spin-off organization to support his second-term agenda.

The outside group, Organizing for Action, will employ many of the same people who led Obama's two presidential bids and will have access to his campaign's voter and donor data. The new group is expected to focus on backing his positions in legislative battles, including gun control and immigration.

Some of what the president may pursue, particularly when it comes to climate change, may be through executive branch actions that don't need congressional approval.

The Pentagon this week acted on its own to lift a ban that kept female service members out of combat positions. And the Education Department unilaterally ordered schools to include students with disabilities in sports programs or provide equal alternative options.

White House officials are scouring rule books for other actions the West Wing and government agencies can take on their own.

For 6- and 7-year-olds, there was a 27 percent increased risk. Overall, kids who ate fast food three or more times a week had about a 30 percent increased risk of severe allergies. The results were consistent across all age groups regardless of gender or socioeconomic status. ?

Interestingly, kids who ate fruit were able to cut their risk of developing these conditions. Researchers found that kids who ate three or more portions of fruit each week reduced their risk of severe asthma, eczema and allergies by between 11 and 14 percent.

First clinical trial in the US and Europe

(CHICAGO) Rush University Medical Center is conducting the nation's first clinical study of an innovative stem cell drug, Cartistem, to repair knee cartilage damaged by aging, trauma or degenerative diseases such as osteoarthritis.

Cartistem is manufactured from mesenchymal stem cells derived from allogeneic (donor) umbilical cord blood. Umbilical cord blood is a readily accessible source of high-quality stem cells, is associated with minimal health risks and carries relatively few ethical concerns.

The stem cells are mixed with hyaluronan, a natural polymer that plays a major role in wound healing and is a building block of joint cartilage. Cartistem is surgically administered into the area of cartilage damage following an arthroscopic surgery as an adjunct to microfracture, a commonly used technique used to repair cartilage damage.

The principal investigator on the study is Dr. Brian Cole, a professor in the department of orthopedics and anatomy and cell biology at Rush University Medical Center. Dr. Cole is the head of Rush's Cartilage Restoration Center and is also the head team physician for the Chicago Bulls. Cole and his co-researchers will assess the drug's safety as well as its ability to regenerate cartilage repair tissue and reduce pain in patients with localized cartilage loss in the knee.

Treating cartilage damage can be problematic because the tissue does not contain blood vessels or nerves and therefore has a limited ability to re-grow. Various treatments for cartilage degeneration, such as drug therapy, arthroscopy and joint replacement, yield mixed results and are unable to regenerate damaged tissue.

"Finding a biological solution for cartilage regeneration in orthopedics is one of the fastest growing areas of research and development in our specialty, said Cole. "Rush is spearheading this field of research with the ultimate goal of safely improving outcomes and sparing patients from having more complicated surgery at a relatively young age."

The two-year, phase I/IIa study will enroll a total of 12 participants aged 18 years and older, with a body mass index of less than 35. Initially, six individuals with lesions sized 2 to 5 centimeters will be recruited into the study; an additional six volunteers with lesions larger than 5 centimeters will be enrolled sequentially. Each participant will undergo eligibility screening followed by a 12-month observation period to determine the safety and efficacy of the drug with an additional long-term follow-up evaluation at 24 months.

"With a burgeoning aging, yet active population, our patients are looking for effective non-joint replacement solutions to treat their damaged knee cartilage," said Cole. "This research is significant in that it utilizes a commonly performed operation (microfracture) in an effort to improve upon variable outcomes."

"Notably, this is a treatment for patients with localized cartilage damage and not for patients who are diagnosed with diffuse or bone on bone arthritis who have otherwise been told they require a knee replacement." said Cole.

Treating cartilage damage can be problematic because the tissue does not contain blood vessels or nerves and therefore has a limited ability to re-grow. Various treatments for cartilage degeneration, such as drug therapy, arthroscopy and joint replacement, yield mixed results and are unable to regenerate damaged tissue.

"Finding a biological solution for cartilage regeneration in orthopedics is one of the fastest growing areas of research and development in our specialty, said Cole. "Rush is spearheading this field of research with the ultimate goal of safely improving outcomes and sparing patients from having more complicated surgery at a relatively young age."

The two-year, phase I/IIa study will enroll a total of 12 participants aged 18 years and older, with a body mass index of less than 35. Initially, six individuals with lesions sized 2 to 5 centimeters will be recruited into the study; an additional six volunteers with lesions larger than 5 centimeters will be enrolled sequentially. Each participant will undergo eligibility screening followed by a 12-month observation period to determine the safety and efficacy of the drug with an additional long-term follow-up evaluation at 24 months.

"With a burgeoning aging, yet active population, our patients are looking for effective non-joint replacement solutions to treat their damaged knee cartilage," said Cole. "This research is significant in that it utilizes a commonly performed operation (microfracture) in an effort to improve upon variable outcomes."

"Notably, this is a treatment for patients with localized cartilage damage and not for patients who are diagnosed with diffuse or bone on bone arthritis who have otherwise been told they require a knee replacement." said Cole.
